In a recent ruling, the Chhattisgarh High Court has ruled that a wife’s repeated allegations, in various forums, of her husband having an illicit relationship with his own mother amounts to mental cruelty and is an attack to sacred Relation of mother and son.

The bench, comprising of Justice Goutam Bhaduri and Justice Sanjay S. Agrawal, allowed the appeal filed by the husband, overturning the family court’s decision to refuse a divorce decree.

The case involved a couple who got married in May 2011. The husband claimed that his wife’s behavior towards him became hostile after marriage, as she frequently hurled abuses at him and his mother. In response, the husband sought a divorce decree from the family court, which was initially denied.

Upon reviewing the evidence presented, the court found that the wife had deserted the husband in December 2013 and had filed a false complaint against him and his relatives under Section 498-A. However, all of them were acquitted due to lack of evidence. Additionally, the wife admitted in court that she accused her husband of maintaining illicit relations with his mother.

However, considering the wife’s entitlement to maintenance, the court determined a monthly maintenance amount of ₹35,000 would be deducted at source from the husband’s salary.
