This is a case from Feb 2021, where a father spent over 3 years (since August 2017) in jail due to false rape case by daughter. The FIR was registered by her uncle.
On the basis of the complaint, which was filed by the girlโs uncle at the Modinagar police station in 2017, cops arrested the girlโs father under various sections of IPC and POCSO Act and a court sent him to judicial custody. The case was heard in the court of special judge (POCSO Act) Mahendra Srivastava.
Special public prosecutor (POCSO Act) Utkarsh Vats said that the girl lived with her maternal uncle and on his insistence, she got ready to implicate her father in a false rape case.
During the hearing, the girl turned hostile and said that she had framed her father on her uncleโs advice.
On this basis, the court acquitted the man, who had been in jail since the time the FIR was lodged. Judge Srivastava also imposed a fine of Rs 50,000 on the man who provoked the girl to file the false rape case.
On 12th February, a special court in Ghaziabad then sentenced the man to one-month simple imprisonment and also imposed a fine of Rs 50,000 on him for provoking his niece to file a false rape case against her father.
The court also ordered that 50% of the money received in the fine would be given to the father of the girl.
