In this case, the wife filed a complaint in December 2021, alleging that during their marriage in 2017, the husbandโs family wanted a gold coin for each family member; because the demand was not met, the wife was harassed.
Based on these allegations, a FIR was filed against the husband under Section 498A and the Dowry Prohibition Act. Meanwhile, the husband made counter-allegations.
After considering both partiesโ submissions, the Court concluded that the husbandโs custody will not resolve the issue.
While granting anticipatory bail to the husband accused of cruelty and dowry demands by his wife, single-judge Justice SV Kotwal noted that they were constantly arguing.
Justice Kotwal remarked orally during the case hearing that โmarriages are not made in heaven, they are made in hell.
In the event of arrest, the police has been directed to release the husband on bail if he provided a bail bond of Rs. 30,000 with one or more sureties.
Government should take immefiate action to modify the rules against false allegation made by the wives and they also be punished against false cases of 498A & 125 CRPC etc.
