The Karnataka High Court has stayed criminal proceedings against a man accused of having sexual relations with a woman on a false promise of marriage, observing that allegations of “ghosting” and “seen-zoning” her did not, by themselves, satisfy the ingredients of an offence under Section 69 of the BNS.
The order was passed by Justice M Nagaprasanna in Thufail Ahmed v. State, after the accused approached the High Court seeking a stay on proceedings.
•The case arose from a complaint filed by the man’s former partner, who alleged that their relationship began in December 2025.
•She claimed that the petitioner told her he was travelling to Chennai to visit his ailing father, who was undergoing medical treatment.
• After becoming suspicious of his explanation, the woman allegedly asked him to join her on a video call. He allegedly stopped taking her calls and later blocked her,
• The complaint accused the petitioner of offences under Sections 69 and 115 of the BNS.
Justice Nagaprasanna observed that there was no other material before the court that could fulfil the essential ingredients of an offence under Section 69.
