𝗪𝗼𝗺𝗮𝗻 𝘀𝗲𝗻𝘁 𝘁𝗼 𝗷𝘂𝗱𝗶𝗰𝗶𝗮𝗹 𝗰𝘂𝘀𝘁𝗼𝗱𝘆 𝗳𝗼𝗿 𝗿𝗲𝗴𝗶𝘀𝘁𝗲𝗿𝗶𝗻𝗴 𝗳𝗮𝗹𝘀𝗲 𝗙𝗜𝗥 𝗼𝗳 𝗿𝗮𝗽𝗲- 𝗛𝗮𝗶𝗹𝗮𝗸𝗮𝗻𝗱𝗶

In a landmark judgement on July 15, a lady has been sent to judicial custody by the Additional Session Judge in Hailakandi, Assam, for filing a false case of rape.

A case has also been registered against the lady under section 193 and 195 IPC for giving false evidence/ declaration before the court.

It may be mentioned here that the lady in her FIR stated that the accused person “raped her” and for which the case was registered under section 448 and 376 IPC.

The court stated that she gave false evidence and the accused prayed for initiating a proceeding against the lady. According to the accused, the lady was having a grudge against him out of a lamd dispute.

The court in its order said, “Offence of rape is serious in nature. Whenever any such incident is reported, humanity as a whole starts raising protest against such barbarous act and the society demands severe punishment against the wrong doers. Sometimes, it is felt that some false cases are also filed and for which, the lives of many male persons get spoiled. Court of law is established to deliver justice to the person whose rights have been infringed.”

“The court or police authorities can’t be used as a tool of oppression to others.Justice demands that whoever abuses the process of law should also get a lesson so that similar minded person in the society would be dettered from such acts in future,” the court further added.

“This judgement is a clear message to all the people who try to settle their personal enemities by making false allegations and misuse the police and judicial system. This judgement should act as a strong warning to all those people who give false FIRs and waste the already stretched resources of criminal justice system for their personal motives” the Hailakandi police said.
