Recently, the Madhya Pradesh High Court dismissed an appeal filed by a husband for a grant of divorce. The court held that being a father and husband the man cannot run away from his responsibility by taking the ground that he wants to serve his mother and father for the rest of his life.

In this case, the appellant had filed an application before the family court seeking a divorce on u.s 13 of the Hindu Marriage Act.

However, the Family Court dismissed the application on the ground that the dispute between the couple was petty in nature and will not amount to cruelty and the husband was not entitled to a divorce.

Disappointed with the decission of the family court, the appellant-husband filed an application at the MP High Court.

The Bench of Justice Vivek Rusia and Justice AN Kesharwani stated that on the basis of Hindu Law, marriage is a sacred tie and the last ten sacraments could never be broken. The court also said that marriage is not only considered sacred but is also considered a holy union.

The court remarked that the man being a husband and a father can’t run away from his responsibilities by stating that he wants to serve his parents for the remained of his life.

In this context, the court ruled that the husband was unable to make a case for a grant of divorce and dismissed the appeal filed by the husband.
